  22. SOFTWARE LICENSE AGREEMENT
  23. OF Jesse Deutsch, the doss boss

  26. Ownership of the Software
  27.  
  28. 1.  The enclosed Licensor software program ("Software") and the
  29. accompanying written materials are owned by Licensor [or its
  30. suppliers] and are protected by United States copyright laws, by
  31. laws of other nations, and by international treaties.
  32.  
  33. Grant Of License
  34.  
  35. 2.  Licensor grants to you the right to use one copy of the
  36. Software on a single computer. You may load one copy into permanent
  37. memory of one computer and may use that copy, or the enclosed
  38. diskettes, only on that same computer.

  42. Restrictions on Use and Transfer

  44. 3.  You may copy and transfer the software provided all files,
  45. accompanying documentation and copyright notices are retained.  
  46.  
  47. 4.  You may copy and transfer this program in keeping with proviso
  48. number 3 above, and in accord with generally accepted customs of
  49. shareware transfer.

  52. 5.  You may not reverse engineer, decompile, or disassemble the
  53. Software.

  55. Limited Warranty
  56.  
  57. 6.  Licensor warrants that the Software will perform substantially
  58. in accordance with the accompanying written materials for a period
  59. of 90 days from the date of your receipt of the Software. Any
  60. implied warranties on the Software are limited to 90 days. Some
  61. states do not allow limitations on duration of an implied warranty,
  62. so the above limitation may not apply to you.

  64. 7.  LICENSOR DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR
  65. IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF
  66. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-
  67. INFRINGEMENT, WITH RESPECT TO THE SOFTWARE AND THE ACCOMPANYING
  68. WRITTEN MATERIALS. This limited warranty gives you specific legal
  69. rights. You may have others, which vary from state to state.

  71. 8.  LICENSOR'S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY SHALL
  72. BE, AT LICENSOR'S CHOICE, EITHER (A) RETURN OF THE PRICE PAID OR
  73. (B) REPLACEMENT OF THE SOFTWARE THAT DOES NOT MEET LICENSOR'S
  74. LIMITED WARRANTY AND WHICH IS RETURNED TO LICENSOR WITH A COPY OF
  75. YOUR RECEIPT. Any replacement Software will be warranted for the
  76. remainder of the original warranty period or 30 days, whichever is
  77. longer. These remedies are not available outside the United States
  78. of America.

  80. 9.  This Limited Warranty is void if failure of the Software has
  81. resulted from modification, accident, abuse, or misapplication.

  83. 10.  IN NO EVENT WILL LICENSOR BE LIABLE TO YOU FOR DAMAGES,
  84. INCLUDING ANY LOSS OF PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR
  85. CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE
  86. THE SOFTWARE. Because some states do not allow the exclusion or
  87. limitation of liability for consequential or incidental damages,
  88. the above limitation may not apply to you.

  90. 11.  This Agreement is governed by the laws of the State of
  91. Colorado.

  97. 13.  U.S. Government Restricted Rights. The Software and
  98. documentation are provided with Restricted Rights. Use,
  99. duplication, or disclosure by the Government is subject to
  100. restrictions set forth in subparagraph (c)(1) of The Rights in
  101. Technical Data and Computer Software clause at DFARS 252.227-7013
  102. or subparagraphs (c)(1)(ii) and (2) of Commercial Computer Software
  103. - Restricted Rights at 48 CFR 52.227-19, as applicable. Supplier is
